(1) A person who, except in accordance with the provisions of this Act or with the approval of the Environmental Protection Agency-

(a) interferes with or alters the flow of; or

(b) pollutes or fouls any water resource beyond such level as the Environmental Protection Agency may prescribe,

commits an offence and is liable on conviction to a fine not exceeding c5 million or to a term of imprisonment not exceeding two years or to both.
