(1) A detained person who while in custody in Ghana pursuant to a transfer order made under section 37 (2), escapes or attempts to escape from custody may be arrested without warrant by an authorized person and returned to the custody or another custody determined by the Minister.

(2) A person who rescues or attempts to rescue from custody a person being transferred to or from Ghana pursuant to a request under this Act, commits an offence and is liable on summary conviction to a term of imprisonment of not more than two years.
