(1) The court may in an action relating to a restraint or confiscation order pursuant to section 56, require notice to be given to a person who appears to have an interest in the property and that person shall be added as a respondent to the application.

(2) If the court is satisfied .that the person added as a respondent to the application

(a) has an interest in the property which is the subject of the application, and

(b) has exercised reasonable care to ensure that the property is not from the proceeds of a serious offence, the court shall order that the interest of that person shall not be affected by the order and the order shall also declare the nature and extent of the interest of that person.

(3) Without limiting subsection (2), the court may make an order for payment of damages or costs in relation to the registration of the restraint or confiscation order.
