(1) The Authority may monitor the use of any communications equipment to determine the standard of performance of the equipment.

(2) Where any person operates a communication system in such a manner as to cause damage to the equipment or to the operations of another operator, the matter may be referred by either party to the

Authority which shall determine the matter and award such compensation to the aggrieved persons as the Authority considers just and fair in the circumstances of the case.

(3) Subsection (2) of this section is without prejudice to the rights of the parties to institute action in the courts.
