(1) A law enforcement officer may

(a) enter and search any land, premises, facility, or vehicle and seize any substance suspected to be hazardous wastes or other wastes found on that land, premises, facility, or vehicle; and

(b) arrest a person on whose land, premises, facility, carrier or vehicle a substance suspected to be hazardous wastes or other wastes are found.

(2) A person who is in possession of hazardous wastes or other wastes is for the purposes of this Act, the importer of that hazardous wastes or other wastes and is liable to the penalty specified under section1, unless that person satisfies the Court that that person did not have knowledge of the hazardous wastes or other wastes on the land, premises, facility or vehicle.
