A self-regulatory organization shall not make a decision under its rules that is likely to adversely affect the rights of a person unless

(a) that self-regulatory organization has given that person an opportunity to make representations about the matter; or

(b) the self-regulatory organization considers, on reasonable grounds, that any delay in making the decision will adversely affect a  class of consumers, investors or members of the relevant sector or industry.
