(1) A person who withholds information

(a) which becomes available to the applicant after the approval of the application, and

(b) which could change the evaluation of risk posed by the intended activity of the person commits an offence and is liable on summary conviction to a fine of not less than two thousand five hundred penalty units and not more than five thousand penalty units or to a term of imprisonment of not less than five years and not more than ten years or to both the fine and the term of imprisonment.

(2) Where an applicant has information which the applicant ought to have disclosed with the application, but does not do so, the applicant commits an offence and is liable on summary conviction to a fine of not

less than two thousand five hundred penalty units and not more than five thousand penalty units or to a term of imprisonment of not less than five years and not more than ten years or to both the fine and the term of imprisonment.
