(1) The Central Authority may after consultation with the Minister responsible for Foreign Affairs make a request on behalf of the Republic to the Central Authority of a foreign State or the competent authority of a foreign entity for mutual legal assistance in an investigation commenced or proceedings instituted in Ghana, relating to a criminal matter.

(2) Subject to subsection (4), the request shall be in writing and dated and signed by or on behalf of the Minister.

(3) A request may be made orally due to exigent circumstances but hall as soon as practicable be confirmed in writing.

(4) A request 'in writing' includes e-mail, facsimile or other agreed form of electronic transmission provided that the appropriate levels of security and authentication are in place.
