(1) A person who in the course of his official duties in the administration of this Act has possession of or control over any document or information obtained under this Act and who communicates such document or information or any part of it to any other person to whom he is not authorised to communicate it by any enactment or by the Board commits an offence and is liable on summary conviction to a fine not exceeding ₵500,000.00 or to imprisonment for a term not exceeding one year or to both.

(2) A public officer who has a duty to perform under this Act and fails to perform that duty or performs the duty recklessly shall be liable to such disciplinary action as the Board or the appropriate disciplinary authority may determine.
