(1) The Minister responsible for the Interior in collaboration with the Minister responsible for Foreign Affairs may assist with the removal of a foreign patient from the country to the country of origin of the foreign patient with the consent of the patient or on request by the family of the foreign patient if the patient cannot consent where the patient is not

(a) committed to a psychiatric hospital in pursuance of a criminal charge, or

(b) admitted to a security psychiatric hospital from a prison.

(2) A patient of foreign origin may not be removed to the country of origin of the patient if the Minister on the advice of the Chief Executive of the Mental Health Authority considers it inappropriate.
