(1) Where a person whose name is not in the register

(a) takes or uses a title prescribed under this section,

(b) wears or displays a badge or certificate so prescribed, or

(c) takes or uses any name, title, addition or description implying that that person's name is in the register, that person commits an offence and is liable on summary conviction to a fine not exceeding 250 penalty units or to a term of imprisonment not exceeding 12 months or to both.

(2) Where a person carrying on business in the provision of instruction in the driving of motor vehicles

(a) uses a title or description so prescribed in relation to a person whose name is not in the register but is employed by that person, or

(b) issues an advertisement or invitation calculated to mislead the public with respect to the extent to which persons whose names are in the register are employed by that person, that person commits an offence and is liable on summary conviction to a fine not exceeding 250 penalty units or to a term of imprisonment not exceeding 12 months or to both.
