(1) If the scheme to which a complaint has been referred by the Council under regulation 14(1) fails or refuses to investigate the matter, the Council shall investigate the matter and direct the scheme to comply with the decision of the Council on the matter.

(2) The cost of the investigation under sub-regulation (1) shall be borne by the scheme and the Council may impose such pecuniary penalty for the default as the Council considers appropriate in the circumstances.
