(1) Where it comes to the notice of the Chief Labour Officer that there exists more than one trade union in an undertaking, representing the same class of employees, the Chief Labour Officer shall invite the unions to a meeting to under-take verification to determine which union represents the majority of the workers to be issued with a bargaining certificate, except that the union issued with the Certificate shall consult or where appropriate invite other unions in the course of negotiations to participate in the negotiation process.

(2) Where two or more persons or employers desire to form a Trade Union or Employers Association they shall, register with the Chief Labour Officer and pay a registration fee of three million cedis for a Registration Certificate.

(3) Where there still remains a dispute, the matter shall be referred to the National Labour Commission for a binding resolution.
