(1) Where an enforcement authority

(a) seizes, detains, tests, supervises re-labelling or destroys an appliance which does not  meet the minimum energy efficiency requirements of these Regulations, or 

(b) the Energy Commission destroys an appliance in accordance with these Regulations, the Commission shall surcharge the supplier with the attendant costs.

(2)-Despite sub-regulation (1), where a court convicts a person of an offence in respect of a contravention of any provision of these Regulations, the court may in addition to any order it makes as to costs and expenses, order the person convicted, to reimburse an enforcement authority for any expenditure which has been or may be incurred by the authority in connection with the seizure or detention by or on behalf of the enforcement authority.
