(1) Where an offence under these Regulations is committed by a body  corporate or by a member of a partnership or a firm, every director, or officer of the body corporate  or  a  member  of  the  partnership  or any other person concerned  with  the management of the firm shall be deemed to have committed that offence and is liable on summary conviction to a fine of not more than one thousand penalty units for the offence and is in addition liable to the payment of compensation for the damage resulting from the breach to the satisfaction of the court.

(2) A person shall not be convicted of an offence by virtue of subsection (1) if it is proved that 

(a) due diligence was exercised to secure compliance with the provisions  of these Regulations, and

(b) The offence was committed without the knowledge, consent or connivance of that person.
