(1) All members of the Assembly other than the following shall hold office for twelve months:-

(a) the Executive Chairman;

(b) any person who is a member of the Assembly by virtue of paragraph (b) of subsection (1) of section 12 of this Decree;

(c) the representative of each Regional Sports Council; and

(d) the representative of the Ministry responsible for Education.

(2) Any member of the Assembly other than the Executive Chairman, the representative of the Ministry responsible for Sports and the representative of the Ministry responsible for Education may resign his office by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.

(3) Any person who holds office as a member by virtue of nomination by any authority or body shall cease to hold such office upon his nomination being cancelled by writing addressed to the Executive Chairman who shall forthwith communicate such information to the Commissioner.

(4) If it appears to the Assembly that a member of the Assembly other than the Executive Chairman or a person who is a member by virtue of paragraph (b) of subsection (1) of section 12 of this Decree should be removed from office on the ground of misconduct or inability to perform the functions of his office, the Assembly may, after consultation with the authority or body responsible for his nomination to the Assembly, make a recommendation to that effect to the Commissioner.

(5) Where the Commissioner is satisfied with a recommendation made to him under subsection (4) in respect of any member to whom that section relates, or if he is otherwise satisfied (whether a recommendation has been made in respect of him or not) that any such member should be removed from office in the public interest, he may remove him from such office.

(6) Where the office of a member of the Assembly other than the Executive Chairman becomes vacant for any reason before the expiry of his term of office (if any) the Executive Chairman shall notify the authority or body responsible for his nomination of such vacancy and also the Commissioner.

(7) Where any such vacancy occurs the authority or body responsible for the nomination of a person in place of the previous holder may nominate a person to fill such vacancy.

(8) Any person so nominated shall hold office for the unexpired portion of the previous holder's term of office.

(9) Where any member of the Assembly other than the Executive Chairman or any person who is a member of the Assembly by virtue of paragraph (b) of subsection (1) of section 12 of this Decree is incapacitated by reason of his absence from Ghana or illness or any other sufficient cause from the performance of the duties of his office, the Executive Chairman shall forthwith notify such information to the authority or body responsible for the nomination of such person and such authority or body may nominate another person to act in the place of that member until his incapacity has terminated or until the expiry of his term of office, if any, whichever first occurs.

(10) For the removal of doubts -

(a) where any person who is a member of the National Council as well as a member of the Assembly ceases to be a member of the National Council or ceases for the time being to act as such, he shall also cease to be a member of the Assembly or to act as such until such time as he again becomes a member of the National Council or resumes acting as such; and

(b) any person appointed or nominated to replace him or to act for him or required by this Decree to act for him on the National Council shall be a member of the Assembly in his place or, as the case may be, act in his place on the Assembly until such time as the substituted person ceases to be a member of the National Council or ceases so to act under section 7 of this Decree.

(11) Subject to the provisions of this Decree, any person ceasing to hold office as a member of the Assembly shall be eligible to serve again as a member of the Assembly.
