(1) A sale by auction of any land shall not take place unless the auctioneer has given at least twenty-one days public notice of the sale at the major town of the district in which the land is situated, and at the place of the intended sale.

(2) The notice shall be in writing and shall state the name and place of residence of the vendor and, where necessary, by the beating of drum or gong-gong or any other method intelligible to the public as the District Chief Executive of the district where the sale is to take place may direct.

(3) An auctioneer who sells land by auction in contravention of a provision of this section commits and is liable on summary conviction to a fine not exceeding two hundred and fifty penalty units or to a term of imprisonment not exceeding twelve months or to both the fine and the imprisonment.
